ChapterlGeneralProvisions
Article1TheseRulesareformulatedinaccordancewiththeprovisionsoftherelevantlawsanddecreesforthepurposeofstrengtheningtheadmiministrationofemploymentofforeignersinChina
Article2Theterm"foreigners"intheseRulesreferstothepersons,whoundertheNationalityLawont1ePeople'sRepublicofChina,donothaveChinesenationality.Theterm"employmentofforeignersinChina"intheseRulesreferstoactsofforeignerswithoutpermanentresidencestatustoengageinremunerativeworkwithinChineseterritoryinaccordancewithitlaws.
Article3TheseRulesshallapplytoemployedforeignerswithinChineseterritoryandtheiremployers.TheseRulesshallnotapplyt。foreignerswhoenjoydiplomaticprivilegesandimmunitiesemployedbyforeignembassiesorconsulates,ortheofficesoftheUnitedNationsandotherinternationalorganizationsinChina.
Article4Thelabouradministrativeauthoritiesofthepeople'sgovemmer1toftheprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentandthoseatthePfectureandcitylevelwiththeirauthorizationareresponsiblefortheadministrationofemploymentofforeignersChina.
ChapterIIEmploymentLicense
Article5TheemployershallapplyfortheemploymentpermissionifitintendstoemployforeignersandmaydosoafterobtainingapprovalandThePeople'sRepublicofChinaEmploymentLicenseforForeigners(hereinafterreferredtoasthe"EmploymentLicense").
Article6Theposttobefilledbytheforeignerrecruitedbytheemployershallbethepostofspecialneed,apostthatcannotbefilledbyanydomesticcandidatesforthetimebeingbutviolatesnogovernmentregulationsNoemployershallemployforeignerstoengageincommercializedentertainingperformance,exceptforthepersonsqualifiedunderArticle9(3)oftheseRules.
Article7AnyforeignersseekingemploymentinChinashallmeetthefollowingconditions:(1)18yearsofageorolderandingoodhealth(2)withprofessionalskillsandjobexperiencerequiredfortheworkofintendedemployment;(3)withnocriminalrecord;(4)aclearly-definedemployer;(5)withvalidpassportotherinternationaltraveldocumentinlieuofthepassport(hereinafterreferredtoasthe"TravelDocument").
Article8ForeignersseekingemploymentinChinashallholdtheEmploymentVisasforthewentry(Incaseofagreementformutualexemptionofvisas,theagreementshallPvail.),andmaywokwithinChineseterritoryonlyaftertheyobtaintheEmploymentPermitforForeigner(hereinafterreferredtoasthe"EmploymentPermit")andtheforeignerresidencecertificateForeignerswhohavenotbeenissuedresidencecertificate(i.e.holdersofF,L,CorG-typesvisas),andthosewhoareunderstudyorinterimprogramsinChinaandthefamiliesofholdersofEmploymentVisasshallnotworkinChina.Inspecialcases,employmentmaybeallowedwhentheforeignerchangeshisstatusatthepublicsecurityorganswiththeEmploymentLicensesecuredbyhisemployerinaccordancewiththeclearanceprocedures1undertheseRulesforeignerschangeshisstatusatthepublicsecurityorganswiththeEmploymentLicenseandreceiveshisEmploymentpermitandresidencecertificate.TheemploymentinChinaofthespousesofthePersonnelofforeignernbassies,consulates,rePsentativeofficesoftheUnitedNationsSystemandotherinternationalorganizationinChinashallfollowtheProvisionsofMinistryofForeignAffairsofthePeople'sRepublicofChinaConcerningtheEmploymentoftheSpousesofthePersonnelofForeignEmbassies,ConsulatesandtheRePsentativeOfficesoftheUnitedNationsSysteminChinaandbehandledinaccordancewiththeclearanceproceduresprovidedforinthesecondparagraphofthisarticle.TheEmploymentLicenseandtheEmploymentPermitshallbedesignedandPparedexclusivelybytheMinistryofLabour.
Article9ForeignersmaybeexemptedfromtheEmploymentLicenseandEmploymentpermitwhentheymeetanyofthefollowingconditions:(1)foreignprofessionaltechnicalandmanagerialpersonnelemployeddirectlybytheChinesegovernmentorthosewithseniortechnicaltitlesorcredentialsofspecialskillsrecognizedbytheirhomeorinternationaltechnicalauthoritiesorprofessionalassociationstobeemployedbyChinesegovernmentorgansandinstitutionsandforeignersholdingForeignExpertCertificateissuedbyChina'sBureauofForeignExpertAffairs;(2)foreignworkerswithspecialskillswhowokinoffshorepetroleumoperationswithouttheneedtogoashoreforemploymentandhold"WorkPermitforForeignPersonnelEngagedintheOffshorepetroleumOperationsinthepeople'sRepublicofChina";(3)foreignerswhoconductcommercializedentertainingperformancewiththeapprovaloftheMinistryofCultureandhold"permitforTemporaryCommercializedPerformance".
Article10ForeignersmaybeexemptedfromtheEmploymentLicenseandmayapplydirectlyfortheEmploymentPermitbyPsentingtheirEmploymentVisasandrelevantpapersaftertheirentryentrywhentheymeetanyofthefollowingconditions:(1)foreignersemployedinChinaunderagreementsoraccordsenteredintobytheChinesegovernmentwithforeigngovernmentsorinternationalorganizationsfortheimplementationofSino-foreignprojectsofcooperationandexchange;(2)chiefrePsentativesandrePsentativesofthepermanentofficesofforeignenterprisesinChina.
ChapterIIIApplicationandApproval
Article11TheemployerWhenintendingtoemployaforeigner,stallfillouttheApplicationFormfortheEmploymentofForeigners(hereinafterreferredtoasthe"ApplicationForm")andsubmitittoitscompetenttradeauthoritiesatthesamelevelasthelabouradministrativeauthoritiestogetherwiththefollowingdocumentations:(1)thecurriculumvitaeoftheforeignertobeemployed;(2)theletterofintentionforemployment;(3)thereportofreasonsforemployment;(4)thecredentialsoftheforeignerrequiredfortheperformanceofthejob;(5)thehealthcertificateoftheforeignertobeemployed;(6)otherdocumentsrequiredbyregulations.ThecompetenttradeauthoritiesshallexamineandapprovetheapplicationinaccordancewithArides6and7oftheseRulesandrelevantlawsanddecrees.
Article12Aftertheapprovalbythecompetenttradeauthorities,theemployershalltaketheApplicationFormtothelabouradministrativeauthoritiesoftheprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentorthelabouradministrativeauthoritiesatthePfectureandcitylevelwherethesaidemployerislocatedforexamiexaminationandclearance.Thelabouradministrationauthoritiesdescribedaboveshalldesignateaspecialbody(hereinafterreferredtoasthe"CertificateOffice")totakeuptheresponsibilityofissuingtheEmploymentLicense.TheCertificateOfficeshouldtakeintoconsiderationoftheopinionsofthecompetenttradeauthoritiesandthedemandandsupplyoflabourmarket,andissuetheEmploymentLicensetotheemployerafterexaminationandclearance.
Article13EmployersattheCentrallevelorthosewithoutthecompetenttradeauthoritiesmaysubmittheirapplicationdirectlytotheCertificateOfficeofthelabouradministrativeauthoritiesfortheEmploymentPermit.Theexaminationandapprovalbythecompetenttradeauthoritiesisnotrequiredforforeign-fundedenterprisestoemployforeigners,andsuchenterprisesmaysubmittheirapplicationsdirectlytotheCertificateOfficeofthelabouradministrativeauthoritiesfortheEmploymentLicense,bringingwiththemthecontract,articlesofassociation,certificateofapproval,businesslicenseandthedocumentationreferredtoinArticle11oftheseRules.
Article14EmployerswithpermissiontoemployforeignersshallnotsendtheEmploymentLicensenortheletterofvisanotificationdirectlytoheforeignerstobeemployed1andtheymustbesentbytheauthorizedunit.
Article15ForeignerwithpermissiontoworkinChinashouldapplyforEmploymentVisasattheChineseembassies,consulatesandvisaoffices,bringingwiththemtheEmploymentLicenseissuedbytheMinistryofLabour,theletterortelexofvisanotificationsentbytheauthorizedunitandthevalidpassportorTravelDocument.PersonnelreferredtoinArticle9(1)oftheseRulesshouldapplyfortheEmploymentVisasbyPsentingtheirletterortelexofvisanotificationbyauthorizedunit;personnelreferredtoinArticle9(2)shouldapplyfortheEmploymentVisasbyPsentingtheirletterortelexofvisanotificationissuedbytheChinaNationalOffshoreOilCorporation;personnelreferredtoinArticle9(3)shouldapplyfortheEmploymentVisasbyPsentingtheirletteroftelexofvisanotificationissuedbytheforeignaffairs,officeunderthepeople'sgovernmentofprivinces,autonomousregionsormunicipalitiesdirectlyundertheCentralGovernmentandtherelevantdocumentsofapprovaloftheMinistryofCulture(addressedtotheChineseembassies,consulatesorvisaoffices).PersonnelreferredtoinArticle10(1)oftheseRulesshouldapplyfortheEmploymentVisasbyPsentingtheirletterortelexofvisanotificationbyauthorizedunitandthedocumentationonprojectsofcooperationandexchange;personnelreferredtoinArticle10(2)shouldapplyfortheEmploymentVisasbyPsentingtheirletterortelexofvisanotificationbytheauthorizedunitandtheregistrationcertificationissuedbytheadministrativeauthoritiesofindustryandcommerce
Article16Theemployershould,withinfifteendaysaftertheentryoftheemployedforeignertaketotheoriginalCertificateOfficetheEmploymentLicensethelabourcontractwiththesaidforeignerandhispassportorTravelDocumenttoreceivehisEmploymentPermitwhilefillingouttheForeignerEmploymentRegistrationForm.TheEmploymentPermitshallbeeffectiveonlywithintheareaspecifiedbytheCertificateOffice.
Article17ForeignerswhoreceivedtheirEmploymentPermitshould,withinthirtydaysaftertheirentry,applyfortheresidencecertificatewiththepublicsecurityorgansbringingwiththemtheirEmploymentPermit.ThetermofvalidityoftheresidencecertificatemaybedeterminedinaccordancewiththetermofvalidityoftheEmploymentPermit.
ChapterIVLabourAdn1inistration
Article18Theemployeranditsforeignemployeeshould,inaccordancewithlaw,concludealabourcontract,thetermofwhichshallnotexceedfiveyearsSuchcontractmaybereneweduponexpirationafterthecompletionofclearanceprocessinaccordancewith.
Article19oftheseRules.Article19TheEmploymentPermitoftheemployedforeignershallceasetobeeffectiveupontheexpirationofthetermofthelabourcontractbetweentheforeignerandhisemployer.Ifrenewalisrequired,theemployershould,withinthirtydayspriortotheexpirationofthecontract,submitanapplicationtothelabouradministrativeauthoritiesfortheextensionoftermofemployment,andafterapprovalisobtained,proceedtogothroughformalitiesfortheextensionoftheEmploymentPermit.
Article20Theforeignemployeeshould,withintendaysafterobtainingtheapprovalforextensionofhistermofemploymentinchinaorthechangeofhisemploymentlocationorhisemployer,gothroughformalitiesfortheextensionorchangedhisresidencecertificateatthelocalpublicsecurityorgans.
Article21Aftertheterminationofthelabourcontractbetweentheforeignemployeeandhisemployer,theemployershouldpromptlyreportittothelabourandpublicsecurityauthorities,returntheEmploymentPermitandtheresidencecertificateofthesaidforeigner,andgothroughformalitiesforhisexitfromChina
Article22Thewagepaidtotheforeignemployeebytheemployershallnotbelowerthantheminimumwageinthelocality.
Article23Theworkinghours,restandvacation,worksafetyandhygieneaswellasthesocialsecurityoftheforeignemployeesinChinashallfollowtherelevantprovisionsofthestate.
Article24TheemployeroftheforeignemployeeinChinashallbethesameasspecifiedinhlisEmploymentLicense.WhentheforeignerswitchesemployerswithintheareadesignatedbytheCertificateOfficebutstaysinajobofthesamenature,thechangemustbeapprovedbytheoriginalCertificateOfficeandrecordedinhisEmploymentPermit.IftheforeigneristobeemployedoutsidetheareadesignatedbytheCertificateOfficeorswitchemployerwithinoriginaldesignatedareawhiletakingupjobsofadifferentnature,hemustgothroughformalitiesforanewEmploymentLicense
Article25Forforeignerwhoseres1dencestatusisrevokedbypublicsecurityorgansduetohisviolationofChineselaw,hislabourContractshouldbeterminatedbyhisemployerandhisEmploymentPermitbewithdrawnbythelabouradministrativeauthorities
Article26Shouldthelabourdisputesarisebetweentheemployeranditsforeignemployee,theyshouldbehandledinaccordanceWiththeLabourLawofthePeople'sRepublicofChinaandtheRegulationsofthepeople'sRepublicofChinaonSettlementofLabourDisputesinEnterprises
Article27ThelabouradministrativeauthoritiesshallconductanannualinspectionoftheEmploymentPemritWithinthirtydayspriortheendofeveryyearofemploymentoftheforeigner.theemployershouldgothroughformalitiesoftheannualinspectionattheCertificateOfficeofthelabouradministrativeauthoritiesTheEmploymentPermitshallautomaticallyceasetobeeffectivewhenthedeadlineispassed.IncaseoflossordamageoftheEmp1oymentPermitduringthetermofhisemploymentinChinatheforeignershouldpromptlyreportittotheoriginalCertificateOfficeandgothroughformalitiesfortheissuanceoftheEmploymentPermit.
ChapterVPenaltyProvisions
Article28ViolatlonoftheseRules,i.e.ForeignerswhoworkwithouttheEmploymentPermitoremployerswhichhireforeignerswithouttheEmploymentLicense,shallbehandledbythepublicsecurityorgansinaccordancewithArticle44oftheRulesGoverningthelemplementationoftheLawofthepeople'sRepublicofChinaontheEntryandExitofAliens.
Article29ForforeignerswhorefusetohavetheirEmploymentPermitinspectedbythelabouradministrativeauthorities,changetheiremployersandprofessionsatwillorextendtheirtermofemploymentwithoutpermission1thelabouradministrativeauthoritiesshallwithdrawtheirEmploymentpermitandrecommendthattheirresidencestatusbecanceledbythepublicsecurityorgansincaseofdeportation,thecostsandexpensesshallbebornebythesaidforeignertheiremployers.
Article30ForforeignersandemployerswhoForge,after,falselyuse,transfer,buyandselltheEmploymentPermitandtheEmploymentLicense,ThelabouradministrativeauthoritiesshalltakeovertheEmploymentPermitandtheEmploymentLicenseinquestion,confiscatetheillegalproceedsandimposeafinebetweenthethousandandonehundredthousandRMBYuan.Inseriouscaseswhi-chconstituteacrime,theircriminalresponsibilityoftheperpetratorsshallbelookedintobythejudicialauthorities.
Article31incaseofabuseofpower,illegalcollectionoffees,andfraudulentpracticesonthepartofofficialpersonneloftheCertificateOfficeorotherdepartment,theyshallbeinvestigatedinaccordancewiththelawfortheircriminalresponsibilityifcrimesarecommitted,ortheyshallbesubjecttoadministrativedisciplinarymeasuresifthecasesdonotconstituteacrime.
ChapterVISupplementaryProvisions
Article32TheemploymentinthemainlandoftheresidentsofTaiWan,HongKongandMacaoregionofChinashallfollowtheRulesfortheAdministrationofheEmploymentintheMainlandofResidentsofTaiWan,HongKongandMacao.
Article33TheseRulesdonotapplytotheemploymentofforeignersinChina'sTaiWanHongKongandMacaoregion.
Article34Inpidualeconomicorganizationsandprivatecitizensareprohibitedfromemployingforeigners.
Article35Thelabouradministrativeauthoroftheprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovemmer1tmayformulatetheirownrulesforimplementationoftheseRulesinconjunctionwiththepublicsecurityandrelevantauthoritiesinthelocality,andreportittotheMinistryofLabour,MinistryofPublicSecurity,MinistryofForeignAffairsandtheMinistryofForeignTradeandEconomicCooperationforputtingonrecord.
Article36TheMinistryofLabourshallberesponsiblefortheinterPtationoftheseRules.
Article37TheseRulesshallenterintoforceasof1May1996.TheProvisionsConcerningtheEmploymentinChinaoftheForeignersWhoHaveNotYetObtainedResidenceCertificateandForeignersWhoStudyinChinajointlypromulgatedbytheformerMinistryofLabourandPersonnelandtheMinistryofpublicSecurityon50October1987shallbeannulledsimultaneously.
